Herald Henderson, an arbiter for the NFL, has ruled that Dallas Cowboys running back Ezekiel Elliott’s six-game suspension has been upheld.

Henderson, who receives paychecks from the NFL, kept their initial decision, as the league previously ruled that he was suspended six games due to the personal conduct policy.

While he was suspended, the league is allowing Elliott to play against the New York Giants on Sunday night. It’s believed that they’re allowing him to play ‘due to the timing of the decision.’

An appeals hearing, including Elliott and Henderson, included sworn testimony regarding the alleged domestic violence allegations, lasted three days. Elliott’s ex-girlfriend Tiffany Thompson alleges that he attacked her three days in July 2016, which led to this investigation.

Elliott was suspended in August regarding their personal conduct policy.

“In the absence of a ruling from Mr. Henderson at the outset of the hearing, the judge indicated his desire to have the appropriate time to consider all legal issues before making a ruling,” the league said. “To that end, the judge asked counsel whether it was prepared to allow Mr. Elliott’s suspension, if upheld, to begin after week one allowing him time to make that ruling.

“In deference to the judge, NFL counsel agreed that Mr. Elliott would be permitted to play this weekend regardless of the timing of the decision. When the decision was issued, the judge advised that in light of the league’s agreement, he would allow additional filings and make his decision by Friday.”

The NFL Players’ Association has been attempting to block any ruling from Henderson, or the NFL. Yet, the league went to the U.S. District Court in New York on Tuesday night to block the NFLPA from appealing the arbiter’s decision.

The league said that Roger Goodell, the league commissioner, has the final say in disciplinary decisions.

“The only just decision was to overturn the suspension in its entirety,” Elliott’s attorneys said.
